А.ж. 5 маусымда Конституцияға өзгерістер мен толықтыруларды қабылдау мәселесі бойынша республикалық референдум (Мемлекет басшысының 05.05.2022ж. №888 Жарлығы, бұдан әрі - референдум) өткізіледі (https://kazpravda.kz/n/ukaz-prezidenta-respubliki-kazahstan-9h/).

Ертең, 4 маусымда сағат 00:00-де референдум алдындағы үгіт жүргізу аяқталады («Республикалық референдум туралы» Конституциялық заңның 7-бабының 4-тармағы, бұдан әрі – Конституциялық заң, референдумды дайындау мен өткізу жөніндегі негізгі іс-шаралардың күнтізбелік жоспарының 3-тармағы (Орталық референдум комиссиясының 06.05.2022ж. №32/482 қаулысы)).

Бұл үгітке, соның ішінде қоғамдық пікірге сұрау салу нәтижелерін немесе референдум нәтижелерінің болжамдарын жариялаумен ұштасқанға референдум өткізілетін күннің алдындағы күні және ол өткізілетін күні, яғни а.ж. 4 және 5 маусымда тыйым салынады (Конституциялық заңның 7-бабының 4-тармағы).

Осы күндері – үгітке тыйым салынған кезеңде ол жүргізілген жағдайда Қазақстан Республикасының Әкімшілік құқық бұзушылық туралы кодексінің (бұдан әрі – ӘҚБтК) 102-бабы бойынша жауаптылық туындайды.

Екі немесе одан да көп рет не басқа біреу үшін дауыс беру немесе учаскелік референдум комиссиясы мүшесінің азаматтарға басқа адамдар үшін дауыс беруге мүмкіндік беру мақсатында дауыс беруге арналған бюллетеньдерді беру ӘҚБтК-нің 108 және 110-баптары бойынша жауаптылыққа әкеп соғатынына да назар аударамыз.

Конституцияға (83-бап) сәйкес прокуратура органдары референдумға дайындық пен оны өткізудің барлық сатыларында заңдылықтың сақталуына жоғары қадағалауды қамтамасыз етуде.

Мазмұндалғанды ескере отырып, Бас прокуратура заңдылықты қамтамасыз ету және құқық бұзушылықтардың алдын алу мақсатында азаматтарды, қоғамдық бірлестіктер мен бұқаралық ақпарат құралдарын қолданыстағы заңнаманы қатаң сақтауға шақырады.
