Медиация- тараптардың арасында туындаған дауларды реттеп, оларды өзара келісім арқылы бітімгершілікке шақыратын, тараптардың тілектері мен мүдделерін ескеретін және бірігіп ізденудің арқасында ортақ шешімге келетін тиімді тәсілдердің бірі болып табылады.

          Қазақстан Республикасы «Медиация туралы»  Заңы  28.01.2011 жылдан бастап қолданысқа енгізілді  және ол мына жағдайларда қолданылады- жеке және (немесе) заңды тұлғалар қатысатын азаматтық, еңбек, отбасылық және өзге де құқықтық қатынастардан туындайтын, сондай-ақ онша ауыр емес және ауырлығы орташа қылмыстар туралы, қылмыстық теріс қылықтар туралы істер бойынша қылмыстық сот ісін жүргізу барысында қаралатын даулар (жанжалдар) және атқарушылық іс жүргізуді орындау кезінде туындайтын қатынастар медиацияның қолданылу саласы болып табылады.

Осы медиацияның дауларды шешудегі орны мен артықшылықтарын атап өтетін болсақ - тараптардың өз уақыттары мен қаржыларының үнемделуінде; тараптардың өндіруде және шешім қабылдауда қатысулары. Дауларға (жанжалдарға) қатысушы азаматтардың арасындағы мейірімді қатынастарды сақтап қалу. Дауларды шешу кезіндегі құпиялықтың сақталуы. Дауларды шешетін медиаторлардыды өз еркімен таңдау- болып саналады. 

          Дауды (дау-шарды) реттеу туралы келісімнің тәртібі Қазақстан Республикасының «Медиация туралы» Заңның 27-бабымен реттелген. Сонымен,  медиацияны жүргізу кезінде медиация тараптары қол жеткізген дауды (дау-шарды) реттеу туралы келісім жазбаша нысанда жасалады және оған тараптар қол қояды.  Келісімде медиация тараптары, даудың (дау-шардың) нысанасы, медиатор (медиаторлар) туралы деректер, сондай-ақ тараптар келіскен келісімнің шарттары, оларды орындау тәсілдері мен мерзімдері және оларды орындамаудың немесе тиісінше орындамаудың салдары қамтылуға тиіс.  Дауды (дау-шарды) реттеу туралы келісімді медиация тараптары ерікті түрде осы келісімде көзделген тәртіппен және мерзімде орындауға тиіс.

           Дауды реттеу туралы келісімді сот Қазақстан Республикасының Азаматтық процестік кодексінде көзделген тәртіппен бекіткеннен кейін, іс бойынша төленген мемлекеттік баж «Салық және бюджетке төленетін басқа да міндетті төлемдер туралы» Қазақстан Республикасының Кодексінде (Салық кодексі) көзделген тәртіппен және Қазақстан Республикасының Азаматтық процестік кодексінің 278-бабының негізінде төлеушіге, яғни талап қоюшы тарапқа қайтарылады.

    suppose you typed a catchier title? I am not saying your content is not solid., but suppose
    you added a post title that makes people want more? I mean Медиация - тараптар арасындағы дауды шешу рәсімі » Infozakon is a little plain. You could glance at Yahoo's home page and see how they create post headlines to grab viewers to click.
    You might add a related video or a pic or two to grab readers interested about everything've written. Just my opinion, it would bring your posts
    a little bit more interesting.
